PURPOSE

When visiting the website www.AAA Sportline, you are required to familiarize yourself with our Privacy Policy. Changes and additions may be made to this Policy, and accordingly, AAA Sportline encourages you to periodically review it.

A User who voluntarily provides personal information to AAA Sportline automatically grants permission for AAA Sportline to use the User’s data for storage and processing purposes.

This Privacy Policy defines the rules, purposes, conditions of use, and storage of AAA Sportline Users’ personal data. Based on the Law of Georgia on «Personal Data Protection» and the General Data Protection Regulation (GDPR), AAA Sportline aims to protect Users’ personal data.

This document (Privacy Policy) is an integral part of the terms and conditions of use of the AAA Sportline website, which is a mutually binding document.

DEFINITIONS OF TERMS

The terms used in this document have the following meanings:

  • AAA Sportline (hereinafter «we,» «our,» «website») – LTD «Arveladze Sportsline» established in accordance with the legislation of Georgia, identification code: 405761741, registered at: Georgia, Tbilisi, Saburtalo district, Jiuli Shartava Str. №40;
  • Personal data – any information related to an identified or identifiable natural person. A natural person is identifiable when it is possible to identify them directly or indirectly, including by name, surname, identification number, geolocation data, electronic communication identification data, physical, physiological, mental, psychological, genetic, economic, cultural, or social characteristics;
  • Data processing – any operation performed on data, including collection, retrieval, access, photographing, video monitoring, and/or audio monitoring, organization, grouping, interconnection, storage, modification, recovery, retrieval, use, blocking, deletion, or destruction, as well as disclosure of data by transmission, publication, dissemination, or making it otherwise accessible;
  • The data subject (hereinafter referred to as the User) – any natural person whose data is being processed;
  • Consent of the data subject (User) – the freely and clearly expressed will of the data subject, after receiving the relevant information, to process data about them for a specific purpose, expressed actively, in writing (including electronically) or orally;
  • Data controller – a natural person, legal entity, or public institution that determines the purposes and means of data processing individually or together with others and carries out data processing directly or through a person authorized for processing;
  • Data processor – a natural person, legal entity, or public institution that processes data for the data controller or on their behalf. A person in a labor relationship with the data controller is not considered a data processor; for the purposes of this document, «Georgia Post» Ltd (a identification code: 203836233; Address: Station Square No. 2, 0100, Tbilisi, Georgia) is also considered a data processor;
  • Third-party – a natural person, legal entity, or public institution, except for the data subject, the personal data protection service, the data controller, the data processor, the special representative, and the person authorized to process data by the direct assignment of the data controller or the data processor;
  • Direct marketing – the direct and immediate delivery of information to the data subject by phone, mail, email, or other electronic means to form, maintain, realize, or support interest in a natural person and/or legal entity, goods, ideas, services, work, and/or initiative, as well as image and social topics.

CONSENT

Using the AAA Sportline website is considered as the User’s consent to the Privacy Policy. Accordingly, the User grants AAA Sportline the right to process, store, and use the personal information provided by the User.

This information will be used by AAA Sportline to provide services in accordance with applicable laws. Otherwise, AAA Sportline is unable to provide any kind of service to the User or enter into a contractual relationship.

BASIS FOR DATA PROCESSING

The legal basis for the processing of a User’s data by AAA Sportline and an authorized person is as follows:

  • Data processing is necessary to fulfill an obligation under a contract with the data subject and/or to enter into a contract at the request of the data subject;
  • Based on the User’s consent;
  • To fulfill obligations imposed by a contractual relationship;
  • Data processing is necessary to provide services to the User.

PURPOSE OF PROCESSING USER’S PERSONAL DATA

  • Improving the quality of AAA Sportline’s services;
  • Proper fulfillment of AAA Sportline’s legal obligations;
  • Resolving claims made by the User;
  • Monitoring activities identified by the User on the website;
  • Notifying Users of updated data on AAA Sportline;
  • Effective communication with the User;
  • Establishing feedback from the User;
  • Testing innovations implemented by AAA Sportline;
  • Implementing new products and updates on the website;
  • Identifying groups of Users for whom updates should be offered;
  • Conducting marketing and other activities;
  • Providing information about purchases made by the User;
  • Receiving information from an authorized third party about the User’s fulfillment of monetary obligations;
  • Preventing the improper use of AAA Sportline’s system;
  • Prevention of crimes as provided by the Criminal Code of Georgia;
  • Providing information to competent state authorities;
  • Protecting legitimate interests;
  • Any other legitimate purpose granted to AAA Sportline by the Law of Georgia on Personal Data Protection.

USER RIGHTS

The User has the right to request the following information from AAA Sportline regarding data processing:

  • What data about the User is processed by AAA Sportline;
  • The purpose of data processing;
  • The legal basis for data processing;
  • How the data was collected/obtained;
  • To whom the User’s data was disclosed, the basis and purpose of such disclosure (if applicable);
  • Information on the data retention period or the criteria for determining it;
  • Information about automated processing, including decisions made as a result of profiling and the logic used to make such decisions, as well as the impact of data processing and the expected/probable outcome of processing;
  • The right to access data and receive a copy;

The User has the right to receive the above information no later than 10 working days from their request. This period may be extended by no more than 10 working days in exceptional cases and with proper justification, of which the User will be immediately informed.

Due to the specific nature of AAA Sportline’s activities, User notifications are carried out electronically.

Within 10 working days from the submission of the request by the User, AAA Sportline is obliged to correct/update/complete any incorrect/inaccurate/incomplete data about the User or inform the User of the grounds for refusal of the request and explain the procedure for appealing it.

The User has the right to request AAA Sportline cease, delete, or destroy the processing of their data (including profiling). Within 10 working days of the User’s request, AAA Sportline is obliged to cease/delete or destroy the existing data about the User or inform the User of the grounds for refusal of the request and explain the procedure for appealing it.

In case: the User disputes the authenticity or accuracy of the data; the data processing is unlawful, but the User opposes its deletion and requests the blocking of the data; the data is no longer needed to achieve the purpose of processing, but the User needs it to file a complaint/claim; the User requests the cessation, deletion, or destruction of data processing and the review of this request is in progress; there is a necessity to retain the data for use as evidence; the User has the right to request AAA Sportline to block the existing data about them. The User has the right to receive information about the decision made regarding the blocking of the data or the grounds for refusal of the data blocking immediately upon the decision, but no later than 3 (three) working days from the request. In addition to data storage, AAA Sportline may process it in the following cases: with the User’s consent, to substantiate a legal claim or defense; to protect the interests of AAA Sportline or a third party and in accordance with the law to protect the public interest.

In case the User consents to the processing of their data for one or more specific purposes and/or data processing is necessary to fulfill an obligation under a contract with the User or to enter into a contract at the User’s request and/or the User has given written consent for the processing of special category data for one or more specific purposes (if applicable); they have the right to receive the data they provided to AAA Sportline in a structured, commonly used, and machine-readable format or to request the transfer of this data to another data controller.

The User has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal or similarly significant effects concerning them, except when the decision based on profiling: is based on the User’s explicit consent; is necessary for entering into or performing a contract between the User and AAA Sportline; is authorized by law or under a regulatory act issued within the scope of authority delegated by law.

The User has the right to withdraw their consent given to AAA Sportline at any time and request the cessation of data processing and/or the deletion/destruction of processed data by contacting AAA Sportline’s support team via email. In such a case, AAA Sportline will cancel the User’s personal account and cease data processing and/or destroy the processed data within 10 (ten) working days unless there is another basis for data processing. Before withdrawing consent, the User has the right to request and receive information from AAA Sportline about the possible consequences of withdrawing consent.

The User is entitled to contact the Personal Data Protection Service or the court in case of violating the rights provided by the Law of Georgia on «Personal Data Protection.»

USER’S OBLIGATION

The User is obliged to provide AAA Sportline with complete and accurate information about themselves to receive services. This obligation also extends to changes in the information provided by the User.

CALL CENTER

For the purpose of improving the quality of service at AAA Sportline, addressing issues/faults, providing feedback, and ensuring security, incoming and outgoing calls are recorded, stored, and processed.

TERMS OF USE THE AAA Sportline WEBSITE

By using the AAA Sportline website, the User consents to the storage and processing of his/her personal data and cookies by AAA Sportline.

The User is obligated to provide AAA Sportline with complete and accurate information and to update the information he/she has provided in case of changes.

MINOR

AAA Sportline is unable to verify the authenticity and accuracy of the information provided by the User, including the User’s age. If it becomes known that the information provider is not of legal age, AAA Sportline is authorized to disregard the information provided by the minor. If you become aware that a person registered on AAA Sportline is not of legal age and does not have the consent of their legal representative to use the website, please notify us of this.

WHO WE SHARE USER DATA WITH

Personal data is shared with partner courier service companies, specifically with «Mercury Delivery» LLC (identification code: 203836233; Address: Station Square No. 2, 0100, Tbilisi, Georgia), which ensures the delivery of purchased products to the address specified by the User. The partner courier service company receives the following information about the User: order details, name, surname, address, and contact number. The information provided to the partner courier company is used solely for the purpose of delivering the purchased products.

Sharing of the User’s personal data may be necessary in cases provided by the current legislation of Georgia, for the purpose of detecting, investigating, or preventing a crime.

In line with the User’s interests, AAA Sportline, with the User’s consent, may use the User’s personal information, specifically their name and email address/phone number, for direct marketing purposes, to provide advertising materials, services, products, and to improve the quality of service.

AAA Sportline is authorized to share personal information with any third party in cases provided by the current legislation of Georgia.

CONSENT/WITHDRAWAL REGARDING DIRECT MARKETING

For direct marketing purposes, the User gives consent through an active action.

The User has the opportunity at any time to withdraw the consent given for direct marketing from AAA Sportline. From its side, AAA Sportline will cease direct marketing to the User within a reasonable period after receiving a request regarding withdrawal, but no later than 7 (seven) working days. 

The withdrawal of consent given by the User for direct marketing is done on the AAA Sportline website in the personal account in the following way.

In the User’s personal account, there is a «switch on/off» button through which the User can consent or refuse the processing of information for direct marketing purposes, receiving news and offers via SMS & Email notifications.

AAA Sportline is obliged to record and store the time and fact of consent and withdrawal of consent by the User for the duration of direct marketing activities and for 1 (one) year after the cessation of direct marketing.

A request by the User to cease direct marketing does not obligate AAA Sportline to stop providing information about updates and changes.

LOG FILES AND COOKIES

AAA Sportline uses the standard procedure of log files. Like other websites, AAA Sportline uses Cookies. Log files and Cookies are used to store information about User behavior and improve service quality. Through them, the following information is generated and collected:

  • IP address;
  • Device type;
  • Browser;
  • Time, date, and duration of Website visit;
  • The platform from which the User was redirected to AAA Sportline’s website;
  • Information about actions performed on AAA Sportline’s website what products the User visited.

This information does not identify specific Users and constitutes analytical data.

THE PURPOSE OF PROCESSING SUCH INFORMATION IS TO:

  • Manage AAA Sportline’s website;
  • Produce statistics;
  • Monitor User actions on the website to create an experience;
  • Develop and implement effective marketing activities;

DATA ACQUISITION

AAA Sportline receives information from the following sources:

  • When the User fills out the website registration form;
  • When communication occurs via phone or email;
  • When the User uses AAA Sportline’s website and chat.

TYPES OF DATA PROCESSED

When registering on the Website, the User provides the following information:

  • Mobile number;
  • Email;
  • Address;
  • First and last name;
  • Password for online store authorization.

Providing this information is necessary for registration, without which the User cannot register on the website.

After selecting products, the User is redirected to the bank’s payment page to complete the payment, where they provide their card details and confirm the transaction. AAA Sportline does not have access to the User’s bank card information. AAA Sportline receives information regarding the User’s payment.

RETENTION PERIOD OF CONFIDENTIAL DATA

AAA Sportline is responsible for the confidentiality and security of the User’s personal data.

AAA Sportline stores/processes confidential information about the User for the period necessary to achieve the purpose provided by law, this Policy, and the specific work requirements of AAA Sportline.

AAA Sportline is an e-commerce platform where the Users are authorized to repeatedly use and order the desired item with their account after registration. Consequently, for AAA Sportline to carry out its activities, it is necessary to process the User’s data in parallel. Due to the purpose of this data processing, it is impossible to specifically determine the retention period of the data. Accordingly, AAA Sportline retains the data until the User expresses a desire to cease the processing of their personal data and terminate the contract with them or until circumstances provided by law arise.

SECURITY

For AAA Sportline, protecting the confidential information provided by the User is important. The User’s personal account is accessible only through the User name and password selected by them. AAA Sportline requests that this information not be disclosed to third parties. Otherwise, AAA Sportline disclaims all responsibility.

AAA Sportline takes all measures to protect the User’s confidential information, but does not accept responsibility or guarantee against actions by third parties who illegally access AAA Sportline’s servers.

THIRD PARTY

AAA Sportline disclaims all responsibility regarding other websites that may be linked externally on AAA Sportline’s website. The Privacy Policy of other websites may differ from this Policy. Therefore, AAA Sportline encourages you to review the terms of use and Privacy Policy of the websites indicated as external links.

CHANGES AND ADDITIONS

Changes and additions may be made to this document. In case of changes or additions, the User will receive a personal notification or it will be published on the website.

Changes and additions come into effect after AAA Sportline sends a personal notification to the User or publishes it on the website. After the changes and additions come into effect, the User’s use of the website will be considered as consent to the changed terms.
